Terms of Use

These Terms of Use (“Terms”) govern the Color Hunt iPhone application and related website (together, the “Service”). The Service is operated by Oğuzhan Kayan in Silivri, İstanbul, Türkiye (“Color Hunt”, “we”, or “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the Service.

1. App license

Subject to these Terms, you receive a personal, limited, revocable, non-exclusive, non-transferable license to install and use the App on Apple devices you own or control for personal, non-commercial purposes. The App is licensed, not sold.

Your use of the App is also governed by the Apple Standard Licensed Application End User License Agreement. Our EULA page explains how that agreement and these Terms work together. Where Apple’s agreement must control for App Store distribution, it controls.

2. Eligibility and accounts

You must be legally able to accept these Terms. If you are under the age of majority where you live, a parent or guardian must approve your use. Color Hunt version 1 does not require or provide a Color Hunt account. You are responsible for securing your iPhone and Apple account.

3. Your content

You retain ownership of the photos, titles, color choices, and other material you create or import (“User Content”). You confirm that you have the rights and permissions needed to use and share that content. Color Hunt does not claim ownership of User Content.

User Content is stored locally and is sent elsewhere only when you choose a share destination or an Apple-controlled backup includes App data. Keep separate exports or backups of work you cannot afford to lose.

4. Acceptable use

You may not use the Service to:

• violate law or another person’s privacy, publicity, copyright, trademark, or other rights;
• create, possess, or share unlawful, abusive, exploitative, or harmful material, including sexual content involving minors;
• disrupt, probe, bypass, or compromise the Service, its purchase controls, or its security;
• reverse engineer the App except where applicable law expressly permits it;
• scrape, overload, or use automated systems against the website or related services without permission.

5. Free features and Color Hunt Pro

The free version currently includes 6-photo hunts and at least one export look for each supported format. Color Hunt Pro is an optional auto-renewable subscription that provides ongoing access, while active, to the broader export-template catalog, 8- and 12-photo hunt formats, the Pro profile treatment, and updates made available to Pro members. The exact current benefits are shown in the App before purchase.

6. Subscription terms

• Plans: Pro is currently offered in weekly and yearly periods. The App Store purchase sheet shows the exact product, billing period, localized price, taxes, and currency before you confirm.
• Free trial: an eligible yearly plan may include a 7-day introductory free trial when displayed in the App. Eligibility is determined by Apple. If shown and accepted, the trial converts to the displayed paid yearly subscription unless cancelled before the trial ends.
• Renewal: payment is charged to your Apple account. The subscription renews automatically for the same period at the displayed price unless you cancel at least 24 hours before the end of the current period or Apple specifies another deadline.
• Manage or cancel: open iOS Settings → your name → Subscriptions → Color Hunt. Cancellation stops the next renewal; access normally continues until the current paid period ends.
• Restore: use Restore purchase in the App when using the same Apple account.
• Refunds: Apple controls billing and refund decisions. You can request a refund at reportaproblem.apple.com.

Plan availability, pricing, trial eligibility, and taxes can vary by country or storefront. If the website and the Apple purchase sheet ever differ, the product and terms shown in the Apple purchase flow at the time you confirm are authoritative. Nothing here limits mandatory consumer cancellation, refund, or statutory rights.

7. Changes to subscriptions and features

We may improve, add, replace, or retire templates and features. We will not intentionally remove access you already paid for during its applicable paid period without providing a legally appropriate remedy. Apple will handle required notice and consent for subscription price increases. You can cancel future renewal if a changed offering no longer suits you.

8. Third-party services

Apple distributes the App, processes purchases, manages subscriptions, and provides device services. RevenueCat manages subscription offerings and entitlement status. Cloudflare hosts this website, and Microsoft hosts support email. Third-party services are governed by their own terms as applicable. See the Privacy Policy for data practices.

9. Service availability

We work to keep Color Hunt reliable, but do not promise uninterrupted or error-free availability. Core hunt and export functions are designed to work on-device; purchases, restoration, website access, and some Apple services require a network connection. Device storage, permission changes, operating-system behavior, backups, and third-party outages can affect the Service.

10. Suspension and termination

You can stop using the App at any time and may cancel Pro separately through Apple. Removing the App generally removes local App data from the device, but Apple-controlled backups or transaction records may remain. We may stop distributing the App, discontinue the Service, or deny support where permitted if these Terms are materially violated.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, availability, or preservation of content. These exclusions do not apply where prohibited by mandatory consumer law.

12. Limitation of liability

To the maximum extent permitted by law, Color Hunt is not liable for indirect, incidental, special, consequential, or exemplary damages, or loss of data, profit, goodwill, or opportunity arising from the Service. Where liability cannot be excluded, total liability for a claim is limited to the greater of the amount you paid for Color Hunt in the 12 months before the claim or US$25. Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that applicable law does not allow us to exclude or limit.

13. Indemnity

Where permitted by law, you agree to be responsible for claims and reasonable costs caused by your unlawful use of the Service or violation of another person’s rights. This section does not apply to the extent prohibited by consumer law.

14. Governing law and disputes

These Terms are governed by the laws of Türkiye, without applying conflict-of-law rules. Courts and consumer authorities with jurisdiction under applicable law may hear disputes. If you are a consumer, this choice does not deprive you of mandatory protections or forums available in your country of residence.

15. Changes to these Terms

We may update these Terms as the Service changes. The effective date will be updated here. If a change materially affects existing rights or paid access, we will give reasonably prominent notice where required. Changes do not retroactively alter completed purchases.

16. General provisions

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer these Terms without permission; we may transfer them as part of a lawful reorganization or transfer of the Service, subject to applicable rights.
