Terms of Use
These Terms of Use ("Terms") govern your use of the Color Hunt mobile application and related services (the "App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
1. License to use the App
Subject to these Terms, Color Hunt grants you a personal, limited, revocable, non‑exclusive, non‑transferable license to install and use the App on devices you own or control, for your personal, non‑commercial use. The App is licensed, not sold.
2. Apple End User License Agreement
Use of the App on Apple devices is also subject to Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. See our EULA page for details. Where there is a conflict between these Terms and Apple's EULA in the context of App Store distribution, Apple's EULA governs to the extent required.
3. Accounts
You may use Color Hunt as a guest or with an account. You are responsible for keeping your account credentials secure and for all activity that happens under your account. Keep your contact information accurate so we can reach you about important updates.
4. Your content
You retain ownership of the photos, captions, titles, color choices, and other content you create or upload in the App ("User Content"). You grant Color Hunt a limited, worldwide, royalty‑free license to host, store, transmit, and process your User Content solely to operate, sync, and display features you use — including saving your archive, syncing multiplayer hunts you participate in, generating exports you choose to render, and showing the content back to you and to people you invite. This license ends when the underlying content is deleted from your account, except as required for backup retention or legal obligations.
5. Multiplayer and private invites
Multiplayer hunts are private. Invite codes and links are intended only for people you choose to share them with. You are responsible for who you invite and for the content participants contribute under your event. Invites are time‑limited; expired or cancelled events stop accepting new participants and uploads.
6. Acceptable use
You agree not to use the App to:
- upload, share, or display content that is unlawful, infringing, threatening, harassing, defamatory, sexually explicit involving minors, or that you do not have the rights to use;
- impersonate another person or misrepresent your affiliation;
- attempt to disrupt, overload, probe, or reverse‑engineer the service or its security;
- use automated means to scrape or harvest data;
- interfere with another participant's hunt or with our backend infrastructure;
- violate applicable law.
We may remove content or suspend accounts that violate these rules.
7. App availability
We work to keep Color Hunt available and reliable, but we do not guarantee uninterrupted operation. Features, designs, and templates may evolve. Multiplayer requires an internet connection.
8. Purchases and subscriptions
If and when subscriptions or in‑app purchases are offered, payments are handled by Apple through your App Store account, subject to Apple's terms. Color Hunt does not receive your payment card information. Subscriptions auto‑renew until cancelled; you can manage and cancel subscriptions in iOS Settings.
9. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement, to the maximum extent permitted by law. Color Hunt does not warrant that the App will be uninterrupted, error‑free, or secure, or that any content will be preserved without loss.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Color Hunt be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses arising out of or in connection with your use of the App. Our total liability for any claim arising from the App is limited to the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) US$25.
11. Termination
You can stop using the App at any time. You can delete individual hunts and photos in‑app. You can delete your account in Settings → Delete account. We may suspend or terminate your access if you violate these Terms or to protect the service or other users.
12. Changes
We may update these Terms as the App evolves. We will change the "Effective" date at the top of this page. Continued use of the App after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction where Color Hunt is operated, without regard to conflict‑of‑laws principles. Nothing in these Terms limits any non‑waivable rights you have under local law.
